1. Agreement to Terms

By accessing or using Famori (the "Service"), operated by Iristech ("we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

You must be at least 18 years old to create a primary account and use the Service. By using the Service, you represent and warrant that you meet this age requirement. Parents or guardians may add family members of any age to their family group, but the primary account holder must be an adult.

In these Terms: "Service" refers to the Famori WhatsApp-based family calendar assistant and web application; "User" or "you" refers to any individual who accesses or uses the Service; "Family Group" refers to a group of users connected through the Service; "Content" refers to any data, text, or information submitted through the Service.

2. About the Service

Famori is an AI-powered family calendar and scheduling assistant that allows you to create, manage, and share family events and schedules. The Service is primarily accessible through WhatsApp messaging and is supplemented by a web application.

Features include natural language event creation, family group management, event reminders, recurring event scheduling, shared calendar views, and AI-powered scheduling assistance.

We strive to maintain the Service's availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Your Account

  • Registration via WhatsApp: Your account is created when you first message Famori on WhatsApp and complete the onboarding process. Your WhatsApp phone number serves as your unique identifier.
  • Account security: You are responsible for maintaining the security of your WhatsApp account, which controls access to your Famori account. You must notify us immediately of any unauthorized use.
  • Accurate information: You agree to provide accurate and complete information when creating your account and family group.
  • One primary account per phone: Each phone number may only be associated with one Famori account. You may be a member of one family group at a time.

4. Family Accounts

The Service allows you to create and manage family groups. By creating or joining a family group, you understand and agree to the following:

  • Inviting members: As a family group creator, you may invite other users by their phone number. Invited members must accept the invitation before joining.
  • Roles and permissions: The family group creator serves as the administrator with the ability to manage members and settings.
  • Shared data visibility: All members of your family group can view shared calendar events and schedules. You should only share information you are comfortable making visible to all family group members.
  • Removing members: The family group administrator may remove members from the group. Removed members will lose access to the shared calendar.
  • Children in family accounts: Parents or guardians may add children to their family group. The parent or guardian is responsible for all content and data associated with their child's participation in the family group.

5. Feature-Specific Terms

5.1 Calendar & Scheduling Features

Famori allows you to create, edit, and delete calendar events using natural language through WhatsApp. While we strive for accuracy in interpreting your requests, AI processing may occasionally misinterpret dates, times, or event details. You are responsible for reviewing and confirming important events. Famori is not a substitute for professional scheduling tools in critical or safety-sensitive contexts.

5.2 Reminder & Alert Features

Famori can send reminders for upcoming events via WhatsApp. Reminder delivery depends on WhatsApp availability and your device's connectivity. We do not guarantee that reminders will be delivered at the exact specified time. You should not rely solely on Famori reminders for time-critical matters.

5.3 Tracking & Logging Features

The Service may include features for tracking family activities, habits, or routines. This data is stored for your convenience and is shared within your family group. We do not provide medical, health, or professional advice based on tracked data.

5.4 AI-Powered Features

The Service uses artificial intelligence to process your messages and generate responses. AI-generated responses may occasionally contain errors or inaccuracies. You should verify important information. We are not liable for any consequences arising from inaccuracies in AI-generated content, including but not limited to missed events, incorrect scheduling, or misinterpreted commands.

5.5 Family Sharing Features

Events and information shared within a family group are visible to all members. You are responsible for ensuring that you have appropriate consent before sharing information about other individuals, including family members who are not users of the Service.

5.6 Child-Related Features

When creating events or tracking activities for children, the parent or guardian assumes full responsibility for the accuracy and appropriateness of the information entered. Famori does not provide childcare, medical, educational, or safety advice.

6. Acceptable Use

You agree to use the Service only for lawful purposes. You agree not to:

  • Violate any applicable laws, regulations, or third-party rights.
  • Send spam, unsolicited messages, or abuse the WhatsApp messaging functionality.
  • Attempt to interfere with, compromise, or disrupt the Service or its infrastructure.
  • Use the Service for any commercial purpose not expressly permitted by us.
  • Impersonate another person or misrepresent your identity.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Use automated systems or bots to interact with the Service without our prior written consent.
  • Submit content that is offensive, harmful, threatening, abusive, or otherwise objectionable.
  • Add individuals to a family group without their knowledge or consent.

7. User Content

  • You own your content: You retain ownership of all content you create through the Service, including calendar events, family information, and messages.
  • License to us: By using the Service, you grant us a limited, non-exclusive license to use, store, and process your content solely for the purpose of providing and improving the Service. This license ends when you delete your content or account.
  • Content removal: You may delete your content at any time. We may also remove content that violates these Terms or applicable laws.

8. Intellectual Property

The Service, including its design, features, code, and content (excluding user-generated content), is owned by Iristech and is protected by intellectual property laws. The Famori brand name, logo, and Bivi mascot are trademarks of Iristech. You may not use, copy, or distribute any of our intellectual property without prior written permission.

Your data remains yours. We do not claim ownership over any content you create or submit through the Service.

9. Disclaimers

  • Service "as is": The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
  • No warranties: We do not warrant that the Service will be uninterrupted, error-free, secure, or available at all times. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
  • Not professional advice: Famori is a scheduling and calendar tool. It does not provide medical, legal, financial, educational, childcare, or any other form of professional advice. You should not rely on Famori for decisions requiring professional judgment.
  • Technology limitations: AI processing, WhatsApp delivery, and internet connectivity are subject to limitations and occasional failures beyond our control.

10. Limitation of Liability

  • Maximum liability: To the maximum extent permitted by applicable law, our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or RM50, whichever is greater.
  • Excluded damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses resulting from your use of the Service.
  • Essential purpose: These limitations apply even if we have been advised of the possibility of such damages and even if a remedy fails of its essential purpose.

11. Indemnification

You agree to indemnify and hold harmless Iristech and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights. This includes any claims arising from content you submit, your interactions with other family group members, or your misuse of the Service.

12. Termination

  • You can stop anytime: You may stop using the Service at any time. To delete your account and data, please contact us at dev@iristech.my.
  • We can terminate for violations: We may terminate or suspend your access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
  • Effect of termination: Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination (such as limitation of liability and indemnification) will remain in effect.
  • Data after termination: Following termination or account deletion, your personal data will be deleted within 30 working days, except where retention is required by law or for legitimate business purposes in anonymized form.

13. Dispute Resolution

  • Governing law: These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions.
  • Jurisdiction: Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Malaysia.
  • Informal resolution first: Before filing any formal legal action, you agree to first attempt to resolve the dispute informally by contacting us at dev@iristech.my. We will attempt to resolve the dispute within 30 working days.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make significant changes, we will notify you through WhatsApp or by posting a prominent notice on our website. We will also update the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

15. General Provisions

  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Iristech regarding the use of the Service.
  • Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.
  • No waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by Iristech.
  • Assignment: You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
